The American DCMA oversteps the mark considerably, and needs to be relaxed, while the Swedish law may need to be updated to reflect current technology.
Essentially the argument is as follows. It is illegal to offer copyrighted material, or to have copyrighted, and pirated material on your system. However, Bittorrent being what it is, TPB does NOT HAVE ANY copyrighted material on its website.
.Torrent files do not contain any copyright material. They are just hashes and directions to a tracker. This is the loophole being used, so essentially, TPB is only allowing others to pirate material, rather than distributing it themselves.
All the people that had their livelyhood taken offline because of this police action should be forming a class action as soon as possible. Perhaps those Swedish policemen that are currently "patrolling" Porsche dealerships this week should be afraid.
