Microsoft settles VPN patent case for $200M

Lost in same Texas court that made it pay i4i nearly $300M and banned Word sales

Microsoft today said it will pay communications software maker VirnetX $200 million to settle a three-year-old patent infringement case.

While I've not read the patent, and I'm not likely to shed tears any time soon over Microsoft being found guilty of patent infringement and having to pay someone, I've got to really question if this patent should have ever been granted.

The basic idea, AIUI, is that they are basically encrypting the encrypted channel (double-encryption). That they (VirNetX) have designed their own protocol to do this is completely irrelevant to the fact that the notion of doubling encrypting something is completely obvious.

What fried Microsoft's bacon with the jury, IMO, was the fact that Microsoft THEMSELVES tried to patent this idea and the patent was denied due to prior art. Care to guess what the prior art was?

VirNetX's patents.

So Microsoft WILLFULLY infringed. At that point, the case was pretty much lost for Microsoft, completely irrespective of the merits of the patent itself.
